theconvenienceshop.com (the “Website”) is a website operated by The Convenience Shop Limited (“TCS”, “we” or “us”), a Maltese company with company registration number C 87556 and with registered office at Marant Food Products, Mdina Road, Zebbug, Malta.

These Terms of Use govern your use of this website (the “Website”) and your relationship with TCS.  Please read them carefully as they affect your rights and liabilities under the law. If you do not agree to these Terms and Conditions, please do not register for or use this Website.

1.1  The Website is provided to you free of charge and solely for your personal use, subject to these Terms of Use.  By using the Website you agree to be bound by these Terms of Use. References to these Website Terms of Use include our Terms of Sale and our Privacy Notice. The use of your data is governed by our Privacy Policy , and your purchase of products from this Website is governed by our Terms of Sale.

1.2  These Website Terms of Use apply solely to your general use of the Website and any email correspondence between TCS and you.

1.3  We reserve the right to amend these Terms of Use. If we make any changes to these terms, we will let you know as soon as possible by posting the changes on the Website and updating the date below.  It is your responsibility to read the terms and conditions on each occasion you use this website. If you do not wish to accept the new Terms of Use you should not continue to use the Website.  If you continue to use the Website after the date on which the change comes into effect, your use of the Website indicates your agreement to be bound by the new Terms of Use.

2 Use of Website

2.1 When entering the Website, you agree to not use the Website inappropriately or in contravention of any Maltese and/or European legislation. You may not use the Company Site for any of the following purposes:

You agree that TCS will not be held responsible for any activity on the Website which results from access of a third party with or without your consent.

2.3 You will be responsible for our losses and costs resulting from your breach of this clause 2.

3  Availability and Maintenance of Website

3.1   TCS reserves the right to change, suspend or discontinue the Website at any time, as well as, the right to impose limits on certain features and services or restrict your access to all or part of the Website without prior notice and without incurring any liability.

3.2  Although we undertake to offer you the best service possible, we make no promise that the services at the Website meet your requirements.  We cannot guarantee that the Website will be faultless.  If you would like to contact us regarding a fault in the Website, you may do so either by calling on our freephone 80074600 between 8:00-16:00 from Monday to Friday excluding public holidays, or by sending us an email on [email protected] or by filling in the form on our Contact Us page on our website.

3.3  Your access to the Website may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services.  We will seek to restore the service as soon as we reasonably can.

4.1 The Website includes links to other websites or material which are beyond its control.  We are not responsible for the direct or indirect consequences of you linking to any other website.  We are not responsible for and have no control over the content of any external sites, and the provision of a link is not an endorsement of any other site or its contents.

5.1  The Website and its content is protected by copyright, trademarks, and other intellectual property rights.  The design, text and images of the domain name theconvenienceshop.com/ cannot be used for any publication or any other resource unless prior written approval is obtained from TCS.

5.2 No licence is granted to you within these Website Terms of Use that allows you to use any trademark of The Convenience Shop. Trademarks used on the Website are the sole property of their respective owners and are protected by law.

5.3 When using the Website, you may not copy, reproduce, modify, transmit, distribute or commercially exploit or use any of the materials or content on the Website without prior written permission being granted from TCS.

6   Disclaimer and Limitation of Liability

6.1  The content on the Website is provided for general information only, and although we make reasonable efforts to update the information, we make no representations, warranties or guarantees, whether express or implied, as to the operation of the Website or that the content on the Website is complete, accurate or up to date.

6.2 To the maximum extent permitted by law, TCS shall not be held liable for any liability and responsibility emanating from the use, inability to use or the results of use of the Website for any amount or kind of loss, damage, expenses, costs or liability that you or any third party may suffer, including without limitation any direct, indirect or consequential loss or damage.

6.3 For clarity purposes, the liability borne by TCS from Clause 9 of the Terms of Sale has no connection with this Clause 6 of the Website Terms of Use.

7  Law and Jurisdiction

7.1 The construction, validity and performance of these Website Terms of Use shall be governed by the Laws of Malta.

7.2 It is agreed that the Courts of Laws in Malta shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these Website Terms of Use.
